13-month-old Antonio Santiago was shot and killed when De’Marquise Elkins tried to rob his mother. The baby died from his wounds.
Now Elkins and his 15 year old accomplice Dominique Lang will both be charged as adults in that case as well as the shooting of another man in a robbery attempt at another time.
Even though both can be taken to trial as adults they cannot be given the death penalty because they are under the age of 18.
Police think Elkins shot the baby and wounded his mother during the robbery attempt. He is also accused of shooting a second man when he tried to steal his phone and wallet.
Investigators say a .22 caliber pistol was used in both shootings.
