A man convicted of three counts of lewd molestation in Rogers County heard a judge suspend his ten-year sentence Wednesday, but he still doesn't know when he'll get out of prison.
District Judge Dwayne Steidley ordered David Winsby, 51, into a psycho-educational program, and said he can not be released from prison before he completes it.
"The defendant would not be released from the Department of Corrections until he completes that program, so in fact it would be an open-ended sentence for him to complete this program before he's released," First Assistant D.A. Larry Edwards told KRMG.
Winsby entered an Alford Plea to the three molestation counts in March of last year and got ten years on each count, to be served concurrently, with a one-year judicial review.
That means Winsby will have to show remorse, and accept responsibility for what he's done.
Normally, someone convicted of those crimes would have to serve at least 85 percent of their sentence.
During the judicial review held Wednesday, victim impact statements were read into the record.
Two other female relatives of Winsby said they were also molested by him when they were children, crimes that were never prosecuted and have now passed beyond the statute of limitations.
