Woman found guilty of killing 5 tries to get released from prison

A hearing is set for Thursday that could decide if a woman who was sentenced to more than 100 years in prison on 5 manslaughter charges will be released, based on the Supreme Court’s recent McGirt ruling.

Kimberly Graham, who according to court documents is 1/16th Cherokee, was found guilty of running over and killing 5 people in 2007.

Her lawyers have filed a motion saying the state doesn’t have jurisdiction over her case and are asking the judge to vacate the sentence.

We talked to Bobbi Nickel whose brother, Casey Jones, was one of the victims.

She doesn’t feel like the McGirt ruling was meant to be a loophole.

“It was not put in place to allow criminals to get out, that should not have been out, no mater their ethnicity,” Nickel says.

Police say four of the victims were trying to help a motorcyclist who had fallen over, when they were all hit outside the Backyard Bar at 12th and Memorial in November of 2007.
