Oklahoma state leaders agree to DHS lawsuit settlement with modifications

There are new developments in the federal class-action lawsuit filed against the Oklahoma Department of Human Services.

Oklahoma Governor Mary Fallin and legislative leaders vote to settle the suit Thursday but have modified the settlement agreement.

A child advocacy group out of New York, Children's Rights, filed the suit in 2008 accusing the state of failing to protect children in foster care and seeking changes to the state's child welfare system.

State leaders made changes to the agreement after several hours of meetings on Wednesday and Thursday.

“We’ve taken an important step to move forward to get this lawsuit behind us so we can start with the improvements,” says Governor Fallin after the vote.

Last week, the board that oversees DHS approved a settlement agreement but the changes made yesterday must return back to the DHS Commissioners for approval.

There is a gag order in this case so details of the original settlement and the modified version have not been released to the public.

The child’s advocacy group also has to agree to the terms of the revised settlement.

If not, the trial will move forward with a hearing set for the first week in January 2012.
