What 'competent to stand trial' really means

Tulsa, Okla. —

A jury found Andrew Joseph Dennehy competent to stand trial on Wednesday of shooting a deputy outside of the Tulsa County Courthouse.

Still, what makes a suspect competent?  Local defense attorney Jack Zanerhaft said it comes down to two factors.

"One, he or she understands the charges against him or her," Zanerhaft said.  "Secondly, are they mentally able to assist in their own defense?"

If a person isn't deemed competent, it doesn't mean they will just go free.  Zanerhaft said this brings up new questions.

"Can they be made competent in a reasonable amount of time with medicine and counseling?" Zanerhaft said.

If the suspect is found competent, it doesn't take the insanity defense off the table. He said using the insanity plea and being considered competent is two different things.

"At the time you committed those alleged crimes was your mental capacity so messed up that you couldn't tell the difference between right and wrong?" Zanerhaft said.  "That's the insanity defense."
