Lisa Demaree and her husband took pictures of their three girls, ages 5, 4, and 1 both during and after their baths.
Demaree described the after-bath pictures as "three of the girls are naked, lying on a towel with their arms around each other and we thought it was so cute.”
Walmart employees didn’t agree and called police.
The kids were collected by child services and they weren’t returned until a superior court judge looked at the photos and said they were not pornography.
He ordered the kids returned and the family reunited.
The family is suing the chain, claiming that the company should tell customers that it has a policy against printing such photos and that they would call police if they are found.
A federal judge disagreed and sided with Walmart, pointing out that employees cannot be held liable for reporting what they believe to be child pornography.
The Demarees have appealed the ruling.
